Team overview:

Our Real Estate Disputes team advises on a wide range of contentious issues and has particular expertise in working with property investment companies and investment funds, commercial landlords, occupational tenants, commercial property developers, retailers, technology companies and banks on their property disputes. The team regularly advises on dilapidations, breach of covenant claims, contractual disputes including options and guarantees, service charge and rent review disputes, telecoms, development disputes, possession claims, rights of light, insolvency and property aspects of corporate restructurings.

The team currently consists of a partner, two senior associates, two associates and a trainee.

The team are regularly quoted in the national and property trade press as the 'go to' for expert opinion on real estate dispute issues and high profile judgments.

The Real Estate Disputes team works very closely with Ashurst's leading Real Estate team, being a top tier practice. We are one of a handful of large global law firms for whom both real estate and litigation remains a key area of focus and of strategic importance.

Recent work highlights include:

  •  Advising IBM in relation to all contentious, and potentially contentious, aspects of its UK property portfolio, including the exit from their headquarters in Southbank.
  •  Successfully acting for a landlord client in the recovery of rent arrears through the government's Covid rent arbitration scheme.
  •  Acting for Morrisons plc in the acquisition of McColls' property portfolio as part of McColls' administration.
  •  Acting for Hana Properties as landlord in the contested 1954 Act lease renewal application for the premises occupied by the restaurant Coq d'Argent, now set to be heard at to the Central London County Court.
  •  Acting on behalf of various landlords in the forfeiture of premises for non-payment of rent, including on premises leased by the likes of Boom Cycle and Rushhair.
  •  Acting for an individual on proceedings being heard in High Court relating to the interrelation between the Landlord and Tenant Act 1987 and the Land Registration Act 2002.
  •  Acting for Berkeley Homes in relation to a rights of light dispute in the High Court concerning their development in Kennington, Oval.

Job overview:

The team are recruiting a Real Estate Disputes solicitor to join the London team on a 12 month fixed term contract for parental leave cover. This team is looking for candidates who have 5+years' post admission experience in handing real estate dispute matters. The successful candidate will ideally have gained experience in a City firm or large regional practice.

You will work alongside partners and associates across the real estate sector to provide technically excellent, commercial advice to the team's diverse client base.

Essential skills and experience:

  •  You will be an experienced real estate disputes lawyer and will be able to contribute to know-how initiatives and participate in training where appropriate.
  •  You will have a good knowledge of the law relating to rights of light and real estate insolvency.
  •  You will be effective in communicating with clients in order to understand their needs and how best to meet them. You will also have the ability to assist clients in arriving at practical and cost effective solutions.
  •  You will have a strong academic background and excellent communication and organisational skills.
  •  You will have excellent attention to detail, identifying inconsistencies that indicate problems with quality of work or a misunderstanding of clients' needs.
  •  You will gather information from a variety of sources to identify your own strengths and weaknesses.
  •  You will be ambitious and highly motivated and be willing to go the extra mile in your contribution to the wider Real Estate group.
  •  You will have excellent matter management skills including in relation to client and court deadlines, and billing.
  •  You will be a team-player who can work effectively with colleagues at all levels.
  •  You will have a commercial approach.

This is a one year fixed term contract to provide parental leave cover.
