Job Title: Senior Compliance Analyst / Compliance Manager

Working Hours: 9.30am – 5.30pm;

Group: Vario

Team: Flexible Services - Operations

Location: Birmingham/Glasgow/Regions. The firm operates a hybrid working model and expects employees to work from our offices, at least 3 days per week.  

Reports to: TBC

Purpose of the role:

The purpose of this role is to provide proactive and professional administrative and compliance services across the Flexible Services team. As a member of the team your role will be to assist in carrying out regulatory, financial, security and employment checks on all our Vario Consultants and behalf of our clients both in the UK and internationally.

It is important that the compliance services are delivered to the business in a manner which is consistent and aligned to the policies and procedures that are in place across the Flexible Services Business and more broadly firmwide. This role is intended to embrace a collaborative team-working approach, to fulfil the needs of our clients and the business.   

You are expected to always provide excellent customer service, making positive contributions to the success of the team, and building the business of the firm. You will need to manage your workload proactively and flexibly and perform tasks in a speedy manner.

The role will act as a gatekeeper for ensuring that we meet our regulatory and compliance obligations as well as assisting the firm in managing reputational risk.

Key Responsibilities include but are not limited to the following:

NB: all responsibilities to cover both UK and on occasion, international matters.#

  • Assisting in the processing and onboarding of new Vario Consultants.  This will include:
    • Ensuring all Vario Consultants hold the appropriate Right to Work documentation
    • Ensuring all Vario Consultants hold valid Practising Certificates, dependent on jurisdiction location
  • Assisting with relevant regulatory and compliance checks before a Vario consultant goes on assignment to a client, or comes into Pinsent Masons internally. This will include:
    • Ensuring relevant Right to Work documentation and a valid Practising Certificate are in place before an assignment begins
    • Undertaking an IR35 assessment where applicable and producing a Status determination statement. Taking ownership of this process, this will involve working with the relevant Vario consultant and Flexible Services account manager to collate sufficient information about the working practices to undertake the assessment.
    •  Managing the requirements of the Agency Workers Regulations with regards to comparable pay, benefits and conditions for Vario Consultants placed on assignment. Ensuring appropriate employment/security background checks have been satisfied, client and work type dependant
  • Assisting with relevant regulatory and compliance checks for Vario consultants on assignment before the point of any assignment extension. This will include:
    • Checking Right to Work documentation and Practising Certificates are and remain current for the duration of the assignment period.
    • Checking if a change in working practices requires a fresh IR35 assessment is carried out, undertaking this assessment as required.
  • Maintaining a database of client specific regulatory and compliance requirements
  • Ensuring copies of relevant regulatory and compliance paperwork for Vario Consultants and clients are properly stored on Mercury ( the CRM system used by the Flexible Services Business).
  • Preparing and issuing Key Information Documents to Vario Consultants to comply with the Conduct of Employment Agencies and Employment Business Regulations 2003.
  • Dealing with enquiries from Account Management and Operations team, Vario Consultants and at times, clients directly. 
  • Building a good rapport with internal teams and Vario consultants.
  • Taking part in team meetings
  • Assisting in training as required
  • Assisting in reviewing and updating processes to support compliance requirements
  • Identifying and implementing process and best practice improvements
  • Undertaking projects and other tasks on specific workstreams as needed (e.g adoption of an online IR35 assessment tool)

Relevant Experience:

  • Previous compliance experience in a law firm or other professional services organisation.
  • Previous experience working independently, and with a team within a law firm or professional services environment.

Desirable experience:

  • Previous experience in working with both UK and International compliance matters
