Department purpose

Our Financial Services Regulatory team is comprised of lawyers across our office network, covering all of the world's principal financial markets. We are able to offer our clients expertise in the key regions, from a full-service coverage of the key European jurisdictions, including London and Frankfurt, to our U.S. regulatory practice led from our New York and Washington D.C. offices. We also have well established offices in the Middle East and Asia Pacific region that have been involved in setting up many of the regulatory businesses and systems that exist in those regions today.

Our lawyers offer clients extensive regulatory experience and they lead thinking on regulatory developments, helping clients in lobbying on, planning for and implementing changes as they occur. Areas we advise on include fintech, retail lending and other retail financial services, payment services, crypto asset activities, bank structuring, securities and derivatives regulation, capital and liquidity requirements, marketing and selling restrictions, clearing and settlement, custody and prime brokerage recovery and resolution planning. As an international team we are very experienced in providing international comparative advice on regulatory matters that helps our clients decide where best to conduct their business and gives them a competitive advantage.

Role purpose
We are currently looking for a senior, specialist consumer credit and retail financial services lawyer to join our FS Regulatory team as Counsel in London. Working alongside partners in our Banking, Fintech & Payments, Securitisation and Real Estate teams, the successful candidate will have deep knowledge and experience of the law and regulation of consumer lending, consumer protection (including, for example, unfair terms and unfair trading) and FCA policy and regulation of retail financial services and retail banking. They will have the ability to provide legal expertise to support a range of retail lending products.

Knowledge and experience in related areas such as unregulated lending and FinTech is desirable.

Role and responsibilities
• Advising on product design, marketing, regulatory authorisations and permissions, the drafting of product documentation and disclosures, origination and execution processes, post-contractual matters including agreement administration and servicing and regulatory requirements relating to accounts in arrears and default;
• Advising on unfair terms and consumer protection law and regulation;
• Providing specialist consumer credit and retail financial services regulatory support to other practice areas in the context of securitisation, corporate and banking transactions involving retail financial services products;
• Being the primary point of contact within the firm with respect to developments in the retail finance sector;
• Leading on business development relating to the continued development of the consumer credit practice
including, for example, being a key point of contact between the firm and a range of traditional and fintech
clients, as well as industry associations, with respect to retail lending or other retail regulatory issues, assisting
with submissions to pitch documentation and legal directories as well as managing and developing the firm’s
• client relationships in this space; and
• Provision of consumer credit and retail financial services training to internal and external stakeholders.

The successful candidate will provide high quality legal advice, operate independently and supervise others in the team. Strong communication and influencing skills, and the ability to manage relationships with a range of clients and other stakeholders, will be an integral part of this role.
