The Ashurst London Competition team are highly sought after and have remained at the forefront of the market across the full spectrum of UK and EU competition law for many years, advising clients on a wide range of high-profile, and often ground-breaking matters before national competition authorities the European Commission and the UK and EU Courts. Our team is highly experienced across the full suite of competition law issues including merger clearances, advising on and responding to investigations and prosecutions for cartel conduct, competition and consumer law issues, as well as advising on market investigations and market studies, misuse of market power issues and associated competition litigation.

The London competition team sit within a market-leading global competition and antitrust practice, with a team of over 80 specialist antitrust lawyers across Europe and Asia-Pacific. The team are consistently ranked in the Global Competition Review 'Global Elite', which recognises the world's top 25 competition practices.

Our in-house economists also remain a unique part of the team's proposition. We believe we continue to be the only London law firm able to offer clients fully integrated legal and economics expertise, and clients consistently identify this a crucial differentiating factor that adds significant value across the board but particularly in complex matters.

Job overview:

Associate in Ashurst's EU Competition Team, based in London, but working with colleagues across the wider European Competition team. You will be advising on a full range of EU and domestic competition matters, including: domestic and multi-national merger control, cartel and abuse of dominance investigations, appeals of infringement decisions before EU courts and domestic courts, market investigations, state aid and public procurement.

 

Essential skills and experience:

Experience on a range of UK and EU non-contentious competition law matters (merger control and behavioural matters). Experience on UK/EU contentious competition law matters would also be beneficial.

Recent Work:

As an illustration of the work of the group we are currently acting, or have recently acted:

  • For IHS Markit in connection with its $44 billion merger with S&P Global. The team is advising in relation to merger clearance processes before the European Commission and the UK Competition & Markets Authority, together with the application of the UK National Security and Investment Act
  • For Intel on the remittal to the EU General Court following its successful appeal to the ECJ in the rebates case. This is the most significant Article 102 judgment in more than 40 years and the first time the Commission has been defeated in an Article 102 case since 1979.
  •  Ryder Limited and four other subsidiaries in a £250 million private damages action against 20 defendants arising from the European Commission's decisions in relation to the trucks cartel.
  • For Bank of America in its appeal to the EU General Court against relation to the EU Commissions infringement decision of May 2021 in relation to allegations of collusive conduct in respect of the market for European Government Bonds (EGB).
  • For AVEVA Group plc in relation to its $5 billion acquisition of OSIsoft LLC which required merger clearances in nien jurisdictions in addition to CFIUS approval
  • Cardtronics, Inc. in relation to the US$2.5 billion acquisition of 100% of the company's shares by NCR, Inc.
  • For Morrisons before the CMA in connection with the rival bids by two US private equity firms, Fortress Investments and CDR
  •  PPL Corporation on the £7.8 billion sale of Western Power Distribution (WPD) to National Grid plc. This is one of the largest regulated utility deals in the UK for several years. We advised on merger control, Ofgem regulatory issues given and national security issues.
  • For Hargreave Hale in the FCA's first competition law investigation (relating to an alleged information exchange), and other financial institutions in relation to several of the FCA's market studies.
