We are looking for an Associate to join our highly regarded Regulatory team in Bristol or London, focussing on the area of contentious and non-contentious Public, Utilities and Defence Procurement.

The practice

The Regulated Procurement team sits within our highly respected Regulatory Disputes team and forms part of the firm’s wider Regulatory Group, which has over 40 lawyers working across legal disciplines and industry sectors.

The practice focuses on advising clients on EU and UK public and utilities procurement – from compliance through to bidding and ultimately challenging procurement processes. Our clients are suppliers, public bodies and utilities.

More widely the Regulatory Disputes team advises on regulatory investigations, crisis management, enforcement and prosecutions. They also advise on dealing with economic regulators as well as the full range of other UK and EU regulatory bodies.

The Regulatory Disputes team is led by Catherine Wolfenden, Partner, who is ranked as a Band 1 lawyer in Public Procurement in Chambers UK, 2019.  Craig McCarthy is an Associate Director in the team and is ranked as an Associate to Watch in Chambers UK 2019: " Craig McCarthy advises bidders and contracting authorities on contentious and commercial matters, and is particularly knowledgeable on rail, transport and defence procurement. Clients commend his "excellent technical knowledge and commercial awareness."

The Regulatory Disputes team currently comprises of 3 Partners, 1 Legal Director, 3 Associate Directors, 3 Senior Associates, 2 Associates, 1 Paralegal and a Trainee across our Bristol and London offices. At present, Craig McCarthy, and one Associate focus full time on Regulated Procurement work. The rest of the team advise on a range of other regulatory disputes including Health and Safety and Product Regulation amongst others.

The team are specialist regulatory lawyers who work seamlessly with our expert colleagues across the wider firm to provide an integrated service to clients on their interactions with national and international regulators. We invest in ensuring our lawyers’ top class legal advice is coupled with equally sound commercial guidance.

The Regulatory Disputes team have ambitious plans for growth over the next five years. This is an exciting time to join the team and be an active part of helping to develop and grow the practice.

  • Global software corporation – providing pan-European procurement advice
  • Market leading telecommunications clients – advising on participating in and challenging strategic UK government contract procurements
  • Major UK and multinational transport sector clients – advising on infrastructure, rolling stock, and franchise competitions and challenges
  • Major international defence sector clients – advising on MoD procurement of contracts for future UK military hardware, support and logistics
  • Multinational health sector clients – advice on bidding for and challenging awards of contracts for the supply of personnel, equipment and consumables to the NHS
  • Infrastructure, construction and facilities management clients - advising on complex public procurement issues for numerous high value public sector construction and managed services contracts
  • Utility sector clients – advising on running compliant procurements and defending challenges.

  • Advising Siemens Mobility Limited in its role as successful bidder in the Alstom / Bombardier / Hitachi challenge against London Underground Limited for the Deep Tube contract   Bombardier Transportation UK Limited and Others v London Underground Limited [2018] EWHC 2926 (TCC) 
  • Advising a company specialising in the recovery of cargo from deep water shipwrecks on the successful settlement of £multimillion procurement challenge against the Department for Transport, Blue Water Recoveries Ltd v Secretary of State for Transport [2014] EWHC 2970
  • Advising successful tenderer Mitie as an interested party in the procurement challenge brought by Willmott Dixon to the London Borough of Hammersmith in relation to a multi-million pound FM services contract, Willmott Dixon Partnership Ltd v Hammersmith and Fulham LBC [2014] EWHC 3191
  • Advising the London Borough of Hounslow on a major urban regeneration project and successfully defending a challenge to that process,  AG Quidnet Hounslow LLP v Mayor and Burgesses of the London Borough of Hounslow [2012] EWHC
  • Advising Sita UK on its challenge to a complex negotiated procedure relating to the construction and operation of waste disposal facilities in Greater Manchester, Sita (UK) Limited v GMWDA (2010) EWHC 680 (Ch)

Technical skills and experience

You will have knowledge and experience of regulated procurement (preferably both advisory and contentious) which will have been gained at a well-respected City or National firm. Due to the nature of the work and the structure of the team, we are looking to an Associate, although we will consider candidates with more or less experience.
