THE OPPORTUNITY   

We are currently looking to recruit a bright and ambitious commercial litigator with a strong bias towards, or interest in, corporate crime and investigations. The role will be incredibly varied, and you will work closely alongside a Chambers-ranked partner, focusing on the investigation and prosecution of range of offences including fraud, bribery and corruption, criminal anti-competitive behaviour, health and safety, environmental, food hygiene and safety, product safety, consumer protection (Trading Standards) and dawn raids. The role will be based in our Manchester office but will also require travel to client sites and our other UK and international offices from time to time.     

MAIN DUTIES AND RESPONSIBILITIES  

Some recent matters handled by the team, which gives a strong indication of the type and calibre of work you are likely to be exposed to, are:

  • Operation Modulation - internal investigation into allegations of large scale theft by former senior executives, working with the Police, CPS and Insurers
  • Operation Tardy - successful challenge by way of Judicial Review to illegal warrants of entry, search and seizure by South Yorkshire Police and the Department of Business Innovation and Skills, and on-going investigation into alleged fraud by professional services firm
  • Operation Sharston - internal investigation into whistleblower allegations of bribery and corruption in award of overseas supply contracts
  • Operation Bagpipe - investigation into whistleblower complaint of unethical and potentially fraudulent misrepresentations to financial institution over contractual liabilities in IT estate
  • Operation Adair - internal investigation into employee collusion in sophisticated theft of product from oil terminal
  • R v Lion Steel & others - successful defence of Managing Director charged with Gross Negligence Manslaughter  in the second corporate manslaughter prosecution in the UK
  • Worthington Nicholls - acting on behalf of former Chairman of company following AIM listing (SFO Investigation)
  • R v Balfour Beatty & others - acting on behalf of the company director in respect of a bribery investigation by the Serious Fraud Office
  • R v Fraser & others - acting on behalf of Finance Director of Nylacast Limited in alleged conspiracy to defraud financial institutions of £100m

The team also has experience conducting multiple privileged internal investigations into whistle blower allegations and suspected corporate and employee criminality. We regularly work with investigation committees and internal compliance officers, civil litigation colleagues, Human Resources, law enforcement agencies and insurers to manage complex issues arising from alleged wrong-doing, as well as working with teams of forensic accountants and IT specialists to ensure the appropriate and proportionate capture and analysis of evidence. The hiring partner has particular interest in the powers of regulators, internal investigations and the provision of strategic advice on crisis management.  

ABOUT YOU   

Technical skills

  • We do not set upper or lower limits of PQE for any of our vacancies.  We have however given an indicative PQE as an approximate guide for applicants. Candidates who have between 4 and 8 years' PQE are likely to have the right level of knowledge and have gained the right level of experience needed to be able to undertake this role
  • Candidates will have a mixture of strong litigation and arbitration experience gained at a leading regional or City firm
  • Experience of conducting corporate due diligence, as well as any exposure to AML, tax evasion, contentious SHE and internal investigations are of significant interest
  • Regulatory and/or commercial fraud experience are also highly desirable
  • Ability to demonstrate a deep understanding of the technical issues that are key to our clients
  • Drafts documents using a commercial, client focussed style
  • Complies with professional standards and all relevant regulatory obligations
  • Complies with the firm's systems, policies and procedures in all matters - including compliance, financial systems and time recording
  • Knows and understands how to best utilise information and research resources
