We are looking for an Associate to join our highly regarded property disputes team in London. This is an exciting opportunity to join a dynamic team that has enjoyed significant growth over the last 3 years.

You will have the chance to work with every member of the cross-office team and cover the full spectrum of property disputes matters. The practice

Our specialist real estate disputes lawyers excel in helping clients resolve all manner of disputes, ranging from landlord and tenant to complex and highly technical development disputes. We cover the full spectrum of services and have a wide range of experience, from advising clients on possible angles to exploit in order to add value to investment portfolios or in respect of development site clearance, to early-stage dispute avoidance advice and mediation, full-blown litigation and third-party determination.

As well as handling complex, high value development and landlord and tenant disputes, we also have specialist expertise in niche areas such as rights to light and telecoms disputes.

The team

The team is based across our London and Bristol offices and made up of 25 lawyers overall. The London-based team is led by Gary Lawrenson (Partner) and also consists of 1 Associate Director, 3 Senior Associates, 1 Associate & 1 Trainee Solicitor.

The work

We advised our client, a holding company owned by a major Hong Kong investment fund, on a dispute involving an acquisition of a hotel complex known as Broome Park. This was a highly significant property litigation case involving property rights issues that the Supreme Court had never previously had to consider. It is the defining case on subject of the validity of recreational easements.

We act for the Foresight Group in a dispute involving one of its subsidiaries, Kent Solar Limited. The claim relates to a solar farm on land adjacent to the River Medway and an allegation of trespassing. A successful defence of the claim is of critical importance to the ongoing viability of the solar farm.

We are currently instructed on behalf of the house builder Ward Homes in this significant case. The matter involves a complex breach of contract claim where the claimant is claiming damages on a Wrotham Park basis (which are awarded in lieu of specific performance or injunction, originally in cases of breach of covenant).

We were instructed by GE CIF Property Nominee Company Ltd (GE) to act in proceedings to challenge a light obstruction notice (LON) registered by TFL against our client's property in prime Central London. TFL served the LON as part of a wider re-development of the surrounding area, with potential to significantly impact our client's rights to lights (RTL). The proceedings were compromised favourably for our client.

We have been acting on behalf of SEPD, a subsidiary of SSE (another major client of OC), in relation to its ability to install an additional wire to existing overhead electricity apparatus across land in Poole. With the assistance of appointed High Court Enforcement Officers, we able to secure access to the Occupier's land so that SEPD could undertake the necessary works.

We are acting for Halfords on the renewal of tenancy on one of its stores in Sheffield, with approximately £1m in dispute. The issues to be addressed at trial are that of length of term, rent and interim rent.

Advised Unite in defending a relief from forfeiture application and successfully obtained repayment of more than £100,000 in disputed arrears relating to utilities charges in circumstances where the tenant's premises were not separately sub-metered. The case involved issues relating to agency and unlawful assignment of a tenancy by conduct.

Technical skills and experience

Due to the technical nature of the practice, we are looking for evidence of training ideally gained within a large regional or City Firm. We are also looking for candidates with a good grounding in property disputes matters, ideally having completed a specialist seat during their training.  As a guide, due to the nature of the work and the structure of the team, we are looking to appoint an Associate within this area, although we will consider candidates with more or less experience.
